Terms & Conditions
Last Updated: 10 April 2025 · Effective: 10 April 2025
These Terms and Conditions govern the basis on which Saraburi Counsel provides legal services to clients. By engaging our services or submitting an enquiry through this website, you acknowledge that you have read and understood these terms.
If any aspect of these terms is unclear, please do not hesitate to contact us before proceeding: [email protected] or +66 36 425 9173.
1. About Saraburi Counsel
Saraburi Counsel is a legal practice established in Thailand, specialising in inheritance and estate matters. Our principal office is located at 78 Mittraphap Road, Pak Phriao, Mueang Saraburi, Saraburi 18000, Thailand.
All legal services are provided by or under the supervision of qualified Thai lawyers. We are bound by the professional conduct rules of the Lawyers Council of Thailand.
2. Scope of These Terms
These terms apply to:
- Visitors to the Saraburi Counsel website at saraburi.club
- Individuals submitting enquiries through the contact form or by telephone or email
- Clients who engage Saraburi Counsel for legal services
Where a formal engagement letter is issued, its terms apply alongside and prevail over these general terms in the event of any conflict.
3. No Solicitor–Client Relationship on Enquiry
Submitting an enquiry or browsing this website does not create a solicitor–client relationship. A professional relationship is established only upon the signing of a formal engagement letter and, where applicable, the payment of any agreed retainer.
Information shared during an initial enquiry is treated with discretion, but formal confidentiality obligations attach from the point of engagement, not from the initial contact.
4. Our Services
Saraburi Counsel provides the following principal services in connection with inheritance and estate matters in Thailand:
- Will Drafting Consultation — a considered consultation and written summary for the preparation of a Thai will (฿2,300)
- Probate Petition and Conduct — preparation and conduct of a probate petition before the relevant Thai court, including administrator appointment and supervised estate distribution (฿8,900)
- Complex Estate Administration — a full multi-stage engagement for estates involving property in more than one jurisdiction, including coordination with foreign counsel and resolution of disputes among heirs (฿10,400)
Specific scope, deliverables, fees, and timelines for each engagement are set out in the relevant engagement letter.
5. Fees and Payment
5.1 Fee Basis
Fees are charged on the basis agreed in the engagement letter. The prices published on this website are indicative starting points for standard matters and may vary depending on complexity, urgency, and the involvement of foreign jurisdictions.
5.2 Disbursements
Disbursements — such as court filing fees, official translation costs, notarisation fees, and government publication charges — are payable by the client in addition to professional fees and will be disclosed in advance where these can be estimated.
5.3 Payment Terms
Unless otherwise stated in the engagement letter, payment is due within fourteen days of the date of invoice. We accept payment by bank transfer to the account details provided on invoice.
5.4 Non-Payment
Where invoices remain unpaid beyond agreed terms, we reserve the right to pause work on the matter and, after reasonable notice, to withdraw from the engagement. We will take all practical steps to avoid any prejudice to the client's matter before doing so.
6. Client Obligations
To enable us to conduct your matter effectively, we ask that you:
- Provide complete and accurate instructions and documents when requested
- Notify us promptly of any change in your circumstances relevant to the matter
- Respond to our correspondence within a reasonable time
- Attend court or official appointments as agreed and with reasonable notice given
- Not provide instructions that are misleading or withhold information material to the conduct of the matter
7. Confidentiality
We treat all client information as confidential. We will not disclose details of your matter to any third party without your consent, except:
- Where disclosure is required by law or by a court order
- Where disclosure to foreign counsel, court registries, or government bodies is necessary to conduct your matter
- Where disclosure is required by our professional conduct obligations
Our confidentiality obligations survive the conclusion of the engagement.
8. Conflicts of Interest
We conduct conflict checks before accepting any new matter. If a conflict arises during an engagement — for example where a dispute emerges among heirs in an estate we are administering — we will advise you promptly and take appropriate steps, which may include recommending that one or more parties seek independent representation.
9. Website Content and Accuracy
9.1 General Information Only
The content on this website is provided for general informational purposes and does not constitute legal advice. Laws change, and individual circumstances vary significantly. You should not act on the basis of website content alone without seeking specific legal advice for your situation.
9.2 No Warranty
We take care to keep the information on this website accurate and current, but we make no representation as to its completeness or fitness for any particular purpose. We accept no liability for errors or omissions in website content.
9.3 External Links
This website may contain links to third-party resources for convenience. We do not endorse, control, or accept responsibility for the content of linked websites.
10. Limitation of Liability
Our liability in connection with any engagement is limited to direct losses caused by our negligence or breach of professional duty. We do not accept liability for:
- Losses arising from information provided by you that is incomplete or inaccurate
- Delays caused by courts, government registries, or other parties outside our control
- Consequential, indirect, or speculative losses of any kind
- The conduct or advice of any foreign counsel, whose engagement is a separate matter between you and that firm
Nothing in these terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded by law.
11. Termination of Engagement
11.1 Termination by Client
You may terminate your engagement with us at any time by written notice. We will render a final invoice for work completed to the date of termination and transfer your file and documents to you or to a successor firm upon receipt of outstanding fees.
11.2 Termination by Us
We may withdraw from an engagement with reasonable notice where:
- You have not complied with your obligations under these terms or the engagement letter
- A conflict of interest arises that cannot be resolved
- We receive instructions that would require us to act contrary to our professional obligations
- The professional relationship has broken down to a point where it is no longer practicable to continue
Where we withdraw, we will take reasonable steps to minimise any disruption to your matter.
12. Governing Law and Jurisdiction
These terms and any engagement between you and Saraburi Counsel are governed by the laws of Thailand. Any dispute that cannot be resolved by discussion shall be subject to the exclusive jurisdiction of the Thai courts.
13. Complaints
We are committed to providing a high standard of service. If you are dissatisfied with any aspect of our work, please contact us in writing at [email protected]. We will acknowledge your complaint within five working days and endeavour to resolve it within thirty days.
If you remain dissatisfied following our internal process, you may refer the matter to the Lawyers Council of Thailand.
14. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this page. For active engagements, material changes will be communicated directly. Continued use of our services following notification of changes constitutes acceptance of the revised terms.
